Responsible AI Use Policy

KIBU RESPONSIBLE AI POLICY

This Responsible AI Policy (this “Policy”) describes how Kibu designs, deploys, and expects you to use the artificial-intelligence features of the Kibu Service, and it supplements the “Artificial Intelligence Features” section of the Kibu Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service or, for the Enterprise Services, in the applicable Master Subscription Agreement (the “MSA”).

This Policy applies to all use of AI Features in the Kibu Service. For the Enterprise Services provided to a provider organization under an MSA, Kibu’s Responsible AI Policy incorporated into that MSA, together with the MSA and its Business Associate Agreement, also apply and control over this Policy to the extent of any conflict as to those services.

  1. Purpose and Scope

Kibu offers features that use machine-learning, generative, or other artificial-intelligence models to generate outputs based on inputs (“AI Features,” and the outputs they generate, “AI Output”). Examples include features that help draft, structure, or summarize documentation and notes, suggest activities or educational content, and support administrative and productivity tasks. AI Features are designed to support — not replace — the judgment of qualified professionals, caregivers, and the people who use the Kibu Service.

  1. Human Oversight; No Professional Advice

AI Output is provided as a decision-support aid only. It does not constitute medical, clinical, behavioral, legal, financial, or other professional advice, and it is not a substitute for the independent judgment of a qualified professional or for a Guardian’s or caregiver’s own judgment. You are responsible for reviewing AI Output before relying on it, and for all decisions made and actions taken based on it. A qualified human should review AI Output before it is used for any decision that affects an individual, including any clinical, eligibility, benefits, billing, employment, or care decision.

  1. Not a Medical Device

The Kibu Service, including AI Features, is not a medical device and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. You will not use the Kibu Service in any manner that would require regulatory clearance or approval that it has not received.

  1. Limitations of AI Output

AI Output is probabilistic and may be incomplete, inaccurate, biased, or non-unique, and similar or identical output may be generated for other users. Kibu does not warrant that AI Output is accurate, complete, reliable, original, or non-infringing, and you should evaluate AI Output for your specific context before relying on it.

  1. Permitted and Prohibited Uses

You will use AI Features only for lawful purposes consistent with the Terms of Service and any applicable MSA. You will not use AI Features to: (i) make fully automated decisions that produce legal or similarly significant effects on an individual without meaningful human review; (ii) generate content that is unlawful, discriminatory, harassing, deceptive, or harmful; (iii) reverse engineer, extract, or attempt to replicate the underlying models; or (iv) input data that you do not have the right to provide.

  1. Data, Privacy, and Model Training

Kibu’s handling of information you provide to or generate through AI Features is described in the Kibu Privacy Policy and, for the Enterprise Services, is governed by the MSA and its Business Associate Agreement. Consistent with those terms, Kibu does not use Customer Data or Protected Health Information to train, fine-tune, or improve generally available models made available to other customers except with authorization, or using data that is aggregated or de-identified in accordance with applicable law. Inputs and outputs associated with the Enterprise Services are treated as the applicable organization’s Confidential Information as provided in the MSA.

  1. Fairness and Monitoring

Kibu maintains processes designed to evaluate AI Features for quality and to mitigate foreseeable and material risks of unfair bias in the context of their intended use, and will work to address material issues that users report through Kibu’s support channels.

  1. Transparency and Documentation

Kibu will make available reasonable information about the intended use and known limitations of AI Features. Where AI Features are used, we aim to make it reasonably clear to users that they are interacting with, or relying on, AI-generated output.

  1. Your Accountability

You are responsible for your use of AI Features and for compliance with all laws applicable to your use case, including laws governing automated decision-making, non-discrimination, consumer protection, and healthcare. Organizations and their Authorized Users remain responsible for their obligations under the MSA.

  1. Changes to This Policy; Contact

We may update this Policy from time to time as provided in the Terms of Service and, for the Enterprise Services, as provided in the MSA. We will post the updated Policy with a revised “Last Updated” date.
